The Maxims of Excuse: The Definition and the Authenticating
This research deals with the Excuse Maxims. They are Jurisprudent maxims that represent legislative issues that are tolerant and practical by which the judgments of its parts are known. What can be excused in the means can not be too in the ends. Then what cab be excused in the exposition can not be too in the resolution. What can be excused in the follower can not be too by the followed; and so on. This research elucidates that the history of these Maxims began with Al-Emam Al Rafi'y in the sixth Hijri century. Then, it follows to the later centuries, passing through Eben Noujym, Zarkashi, Sooty, reaching to the contemporary scientists. Such as: Zarka, Nadawy, etc. Eventually, this research presents authenticating the Excuse Maxims and illustrates their ways- invention, explaining and insufficient induction. Then, it explains the argument of these Maxims and the ways in which they work. These ways are based on the measurement of the licenses with regard to the Excuse as a kind of it.
